What is Mediation

Mr. Melendez is a Supreme Court Certified Family Law Mediator and can be hired as a mediator for your family law case whether you have hired an attorney or not.

Mediation is a process that allows parties to negotiate their differences in a safe, confidential and controlled environment with the assistance of a certified mediator. Through the mediation process, parties have the opportunity to voice their interests and concerns so they may work towards settling their issues in a peaceful manner.

Additionally, parties have the best opportunity to come up with options that are most catered to their individual needs. This process is quite different from simply going to court where a judge decides the fate of each party. Though our judges are bright, intelligent and motivated individuals, no matter how good a judge is, they have no way of knowing the details of a marriage or a child’s needs more than the actual parties. This is one of the best reasons to bring a matter to mediation rather than asking a judge to make the decisions.

Pro-Se Mediation

Pro-se mediation is mediation that only involves the parties and the mediator as opposed to the parties with their attorneys. This is a great way to settle a case as the parties are spared the expense of going through two law offices. Pro-se Mediation can be done with an attorney or mental health professional and there are benefits of each. Attorneys have the most knowledge of the forms and the language that goes into a marital settlement agreement and a parenting plan. Mental health professionals are skilled at keeping people in the right mindset for settlement and helping individuals come up with functional parenting plans. Mr. Melendez has had many years of experience helping people resolve their disputes quickly and in an cost effective manner without the assistance of attorneys.
